Clarification Text on the Protection and Processing of Personal Data

Your personal data is important to us. In the processes of processing your personal data, necessary technical and administrative measures are taken to ensure an appropriate level of security in accordance with the current legislation, in order to prevent the unlawful use of your personal data and to ensure its preservation.

DATA CONTROLLER

This Clarification Text on the Protection and Processing of Personal Data (“Clarification Text”) has been prepared by GAİJİN MÜCEVHERAT VE AKSESUAR LİMİTED ŞİRKETİ (“Company”) as the “Data Controller” within the scope of the Personal Data Protection Law No. 6698 (“Law”) and the Communiqué on the Procedures and Principles to be Applied in Fulfilling the Obligation to Inform (“Communiqué”).

PROCESSED PERSONAL DATA

The information you have provided to our Company, including:

  • Name and surname,
  • Mobile phone number,
  • Email address,
  • Delivery and billing address information,
  • Information regarding shopping, order, and payment transactions,
  • Information about campaigns and coupons utilized,
  • Membership information if membership is established,
  • Type of device used, browser information, and IP address,
  • Cookie data,
  • Product preferences and size information (e.g., ring size)

are processed in accordance with the Law and relevant legislation, either wholly or partially by automated means, or by non-automated means as part of any data recording system.

PURPOSES OF PROCESSING PERSONAL DATA

Your personal data is processed for the following purposes:

  • Providing products and services,
  • Executing order, payment, and delivery processes,
  • Providing after-sales support services,
  • Performing membership transactions and enabling the use of membership rights,
  • Responding to requests and questions regarding customer records,
  • Developing and diversifying products and services,
  • Carrying out marketing, campaign, analysis, and reporting activities,
  • Conducting studies tailored to your interests and preferences,
  • Implementing advertising, promotion, and publicity activities,
  • Sending electronic commercial communications with your consent (including SMS, email, WhatsApp; Meta, and Google platforms),
  • Improving website user experience,
  • Creating invoices and accounting records,
  • Managing customer relations and customer satisfaction processes,
  • Evaluating requests, suggestions, and complaints,
  • Ensuring transaction security,
  • Fulfilling legal and regulatory obligations.

PARTIES TO WHOM PERSONAL DATA IS TRANSFERRED AND PURPOSES OF TRANSFER

Your personal data may be shared domestically and, if necessary, internationally, in accordance with the fundamental principles of the Law and limited to the purposes specified above, with:

  • Shopify and affiliated infrastructure service providers,
  • Cargo and logistics companies,
  • Payment institutions and banks,
  • Business partners providing marketing and analysis services,
  • Information technology service providers,
  • Auditing firms,
  • Legally authorized public institutions and organizations, and
  • Legally authorized private law persons.

METHOD OF COLLECTING PERSONAL DATA AND LEGAL BASIS

Your personal data is collected electronically or in writing through:

  • The website www.deliadore.com,
  • Membership and order forms,
  • Purchases made without membership,
  • Email, contact forms, and call center interactions,
  • Cookies and similar technologies.

Your personal data is processed based on the following legal reasons stated in Article 5 of the Law:

  • Explicit provision in laws,
  • Being directly related to the establishment or performance of a contract,
  • Fulfilling the data controller's legal obligations,
  • Being mandatory for the establishment, exercise, or protection of a right,
  • Legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject.

In cases where these conditions are not present, your personal data is processed with your explicit consent.

EXPLICIT CONSENT

Where explicit consent is required, your personal data is processed solely for the purposes and with the transfer parties specified in this Clarification Text, and you may withdraw your explicit consent at any time.

RIGHTS OF THE PERSONAL DATA OWNER

In accordance with Article 11 of the Law, personal data owners have the right to:

  • Learn whether their personal data is being processed,
  • Request information if their data has been processed,
  • Learn the purpose of the processing and whether it is used in accordance with its purpose,
  • Request the correction of incomplete or incorrectly processed data,
  • Request the deletion or destruction of personal data,
  • Request compensation for damages in case of unlawful processing.
